This is professional level work in the Missouri Department of Revenue providing legal advice, counseling and conducting hearings. The scope of responsibility involves work on complex assignments with little supervision. Employees in this classification can be expected to exercise considerable discretion and independent judgment in handling the cases to which they are assigned. These employees can also expect to have contact with all levels of staff and public. In the course of their work, employees in this classification are expected to work in an adversarial environment and to effectively advocate for the Department of Revenue. These employees can also expect some travel. Assignments are generally received from the Managing Counsel or above though some assignments may be self-generated in response to work situations.

Job Duties:

Public and Staff Relations

Develop and maintain positive relationships with the public and fellow workers in order to advance Department goals and minimize negative feedback.

Meet with Managing Counsel, General Counsel and other members of management and staff to inform them of legal issues, problems, progress and projects.

Adhere to all laws, rules and policies in order to demonstrate support of government, administrative systems and appropriate leadership qualities.

Research, Investigations and Hearings

Research, compile and interpret applicable laws, rules, policies and procedures.

Exhibit familiarity and understanding of legal principles and their application within the employee’s area of practice.

Demonstrate knowledge of procedural requirements in the applicable administrative or judicial forum. 

Demonstrate ability to communicate verbally or in written form applicable legal information. 

Communicate with staff or public in order to provide legal advice or counsel.

Appear in court, conduct hearings and try cases in order to present evidence and verbal arguments.

Answer questions and gather information in order to assist in or conduct hearings.

Analyze information in order to determine facts and sufficiency of evidence to prepare for hearings.

Conduct negotiations in order to obtain settlement.

Manage cases in order to meet all required filing and hearing deadlines.

Analyze fiscal notes in order to determine statutory and budget impact on departmental functions.

Information and Correspondence

Compile, organize and summarize papers, notes and information in order to prepare for filing, presentation and further processing.

Compose memoranda, motions and final decisions in order to provide information and prepare for processing.

Explain laws, statutes, policies and procedures to public or staff in order to answer questions and help solve problems.

Read laws and statutes in order to stay abreast of law and statute changes.

Write procedures in order to assist staff in performing assigned responsibilities.

Compose correspondence in order to relay or obtain information.

Minimum Qualifications:

(The following requirements will determine merit system eligibility, experience and education ratings, and may be used to evaluate applicants for Missouri Uniform Classification and Pay System positions not requiring selection from merit registers. When practical and possible, the Division of Personnel will accept substitution of experience and education on a year-for-year basis.)

L.L.B. or J.D. degree or equivalent first degree in law, from a law school approved by the Section of Legal Education.

Currently licensed to practice law in Missouri as a recognized member of the Missouri Bar Association.

Certificate of Admission or Good Standing as issued from the Supreme Court of Missouri.

Additional Desired Qualifications

Knowledge of state driving while intoxicated law, tax law, or bankruptcy law, basic accounting principles and trial advocacy as normally acquired through law courses or continuing education in the above areas.

Trial and appellate practice and government-related legal experience.
